On Trial before a Beit Din This
past Monday, 7.07.08, Shomera for a Better Environment ran a unique Judaism and the Environment event. The
program included a mock
trial, created as a joint
venture with Gazit, the Association for Rabbinical Courts for Financial Disputes. Dayanim (religious judges), lawyers and environmental experts
all participated in a trial that dealt with air pollution caused by a bu Among
the prosecution's arguments were the effect on the health of the residents
and the contractor's deviation from the accepted standards for dust caused by
the construction on the site. The defense argued on behalf of his client that
there would be severe financial damage to both the contractor and those who
purchased the apartments in the bu In
the end, the court ruled in favor of a two week suspension of construction,
which was considered enough time to implement the solutions necessary to
significantly reduce the pollution, without causing severe financial harm to
the contractor.
